Terms of Service

1. Agreement

These Terms are a contract between you and the operator of Pocket Listing Studio (“the app”, “we”, “us”). By creating an account or using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app. You must be 17 years or older to use the app.

2. What the service does

Pocket Listing Studio helps you create resale listings. You photograph an item and provide details; the app uses AI to draft a title, description, suggested price and price range, marketplace-specific formats, and social captions. You can then copy or publish the result to marketplaces and social platforms.

The app is a tool that assists you. It does not buy, sell, appraise, ship, or handle payment for your items, and it is not a marketplace itself.

You keep ownership of the photos and information you put into the app. By using the app you grant us the limited permission needed to store your content and to process it (including sending it to our AI provider, as described in the Privacy Policy) so we can generate and store your listings.

6. AI output is assistive — no guarantee

The app’s AI-generated content, including suggested prices and price ranges, is assistive and provided “as is.” It is an estimate based on the photos and details available, and it can be wrong or incomplete.

Prices in the app are shown in your account’s currency; currency conversions are estimates.

7. Connected accounts and third-party platforms

The app can connect to accounts you own on other platforms so it can publish on your behalf when you ask. Those platforms are independent third parties governed by their own terms and privacy policies. We are not responsible for their availability, decisions, fees, or how they handle your listings or data. You can disconnect a connected account at any time.

We may update, change, or discontinue features of the app. We aim to keep the service running but do not guarantee it will be uninterrupted or error-free. We may update these Terms; if a change is material we will update this page and, where appropriate, notify you in the app. Continued use after an update means you accept the revised Terms.

10. Your data and deletion

You can delete individual items or your entire account from within the app; deletion permanently erases the associated data and photo files. See the Privacy Policy for details, including how de-identified improvement data is handled.

11. Disclaimers

To the fullest extent permitted by law, the app is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost sales, or the outcome of any listing, price, or sale made using the app. Nothing in these Terms limits liability that cannot be limited by law (including under applicable Quebec and Canadian consumer-protection law). No fixed liability cap is stated; the statutory limits of applicable law govern. (D98 — founder chose to keep the statutory wording; counsel may refine.)

13. Governing law

These Terms are governed by the laws of the Province of Quebec and the applicable laws of Canada, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have where you live. Any dispute that is not resolved between us will be brought before the courts of Quebec, Canada. These Terms contain no arbitration clause. (D98.)
